Got Questions?

Frequently Asked Questions

Common questions from London property owners, investors and occupiers about our RICS Dilapidations service, answered by Botley Byrne's chartered surveyors.

What are dilapidations?

Dilapidations are breaches of a tenant’s lease covenants relating to the condition of a property, typically disrepair, and failure to reinstate alterations or meet decoration and yield-up obligations at the end of the term. Landlords can claim the cost of putting these right. Botley Byrne act for both landlords and tenants on dilapidations across London and the UK.

What is a schedule of dilapidations?

A schedule of dilapidations is a document, usually prepared for the landlord, listing the alleged breaches of covenant and the works or cost required to remedy them. An interim schedule is served during the term; a terminal schedule is served at or near lease end. It forms the basis of the claim and any negotiation.

How much can a dilapidations claim cost in London and the UK?

Claims vary widely with the size and condition of the premises and the lease terms, and can run to significant sums on commercial property. Crucially, statutory caps (such as section 18 of the Landlord and Tenant Act 1927) and negotiation often reduce the figure materially, which is exactly where expert surveying advice pays for itself.

Can dilapidations claims be negotiated or reduced?

Yes. Many claims are overstated or fail to account for the diminution in the value of the landlord’s interest, betterment, or the landlord’s own intentions for the property. We prepare or challenge schedules and negotiate robustly to achieve the right commercial outcome, whichever side we act for.

Do you act for landlords or tenants?

Both, though never on the same matter. We prepare and serve schedules and pursue claims for landlords, and we defend and negotiate down claims for tenants. Either way you get independent, RICS-regulated advice focused on the best commercial result.

Are your dilapidations surveyors RICS-regulated?

Yes. Our dilapidations work is carried out by RICS-chartered surveyors within a RICS-regulated firm, backed by professional indemnity insurance, and follows the RICS Dilapidations guidance and the Dilapidations Protocol used across England and Wales.
